Texas Minor Child Power of Attorney Form | |
The Texas minor child power of attorney form is a document that the parent(s) or legal custodian would provide so that a temporary Guardian would have what is needed to properly care for the child(ren) in the absence of the parent(s) or legal custodian.
This document is very clear about how a child may be enrolled into any school system in the state. The document also addresses other responsibilities expected of the temporary Guardian from medical and dental care, to food and clothing provisions and reasonable discipline. The parent(s) or legal custodian, must be well aware that they are surrendering their rights temporarily and that the Guardian assuming temporary custody will have all rights, duties and powers, except, they may not sign for the child(ren) to be adopted or married.
This document must be acknowledged before a Notary Public. This document may be revoked by the parent(s) or legal custodian at any time at their discretion, by placing revocation of powers notice in writing, having it notarized and provision of delivery or service to the temporary Guardian.
How to Write
Step 1 – Guardianship Requirements –
- The Guardian will be responsible to acquire all of the documentation required to enroll the child(ren) into school.
- The Guardian must initial each line preceding each requirement so that the state and school district will know that the Guardian is clear with regard to what is required
- It will be the responsibility of the Guardian to ensure that the parent(s) or legal custodian provides all of the required documentation and information
Step 2 – The Parties – Enter the following:
- Printed name of parent(s) or current legal custodian(s)
- Print the legal name of the child(ren)
- Enter the Date of Birth of all child(ren)
- Submit the name of the person(s) who shall temporarily assume custody of the child(ren)
- Provide the complete address of the person(s) who shall assume custody
- Print the name of the person(s) with whom the child(ren) shall reside
- Print the temporary Guardian’s:
- Street Address
- City
- State
- Zip Code
- The parent(s) or current legal custodian must read the remaining information in this section
Step 3 – Signatures – Before a Notary Public –
- Parent or Current Legal Custodian’s signature
- Printed Name
Notarization –
Once the Notary has witnessed the signatures to this section of the document, the Notary will complete their required information in acknowledgement of this portion of the document
Step 4 – Acceptance of Temporary Guardianship of the Minor Child(ren) –
- Print the name of the of the Temporary Guardian
- Home phone
- Work phone
- Cell phone (or pager)
Step 5 – The Children –
- Enter the name(s) and date(s) of birth of the child(ren)
- Submit the name of the parent or current legal custodian of the child(ren)
- Telephone Number
- Street Address
- City, Zip Code
- The parent(s) or current legal custodian, must carefully review the next three(3) paragraphs in this section. The parent(s) or current legal custodian could be held financially responsible for various situations if they do not make themselves aware of the laws relating to this document.
Step 6 – Signatures – Must sign before a Notary Public:
- Once the parent(s) or current legal custodian have read the information, they must date the document in dd/mm/yy format
- Provide the signature of the resident
- Print the name of the resident
- Enter the County of where the document shall be executed
Notarization –
Once the Notary has witnessed the dating and signature of the resident, the Notary will complete the document by entering their state required information in acknowledgement of this document
