South Carolina Real Estate ONLY Power of Attorney Form

The South Carolina real estate only power of attorney form is a legal document that a Principal will use to assign powers to an Agent for the purpose of refinancing, purchasing and/or selling real property on behalf of the Principal(s). The document also provides permission for the Agent to receive, confirm, create and execute any contracts, deeds, mortgages, notes, affidavits, disclosures, settlement statements, or other instruments of any type necessary to complete any needed transactions necessary to complete any sale, purchase and/or refinancing required by the Principals.

This document must be acknowledged by a licensed state notary public and two witnesses. The document may also be revoked at the discretion of the Principal.

How to Write

Step 1 – Location –

  • Enter the county of where the document will be filed

Step 2 – The Parties – Provide the following information:

  • The name of the Principal(s)
  • The name of the appointed Agent
  • AND
  • Enter the address of the property

Step 3 – Powers –

  • In paragraphs 1,2 and 3, enter the address of the property in all of the blank lines of each paragraph

Step 4 – Commencement and Automatic Revocation of the Document –

  • This contents of this document shall commence on the date of execution of this document
  • Enter the automatic revocation date in mm/dd/yy format

Step 5 – Notarization and Witness Signatures –

  • Date the document in dd/mm/yyyy format
  • Enter the Principal’s signature
  • Print the Principal’s name
  • AND
  • Enter the Agent’s Signature
  • Print the Agent’s name
  • AND
  • Each witness must enter their respective signatures
  • Witnesses printed names

Notarization –

  • Once all of the required signatures have been entered and witnessed by the Notary Public, the Notary will then complete the document with all of the state required information to acknowledge the validity of the document.
