Ohio Real Estate ONLY Power of Attorney Form | |
The Ohio real estate only power of attorney form is a document that will permit a Principal the ability to delegate an Agent to attend to their real property in the event of temporary extended absence and/or illness. This document will only allow an agent to manage, sell, purchase, refinance or conduct transactions on behalf of the Principal. This document will not provide permission to allow the handling of or make decisions regarding to personal finances or the Principal’s health and medical care decisions.
This document must be witnessed and signed by all parties, before a Notary Public. This document may be revoked at the Principal’s discretion.
How to Write
Step 1 – The Parties – Enter:
- The Principal’s full name
- Street Address
- City
- State
- AND
- The appointed Agent’s full name
- Street Address
- City
- State
Step 2 – Article I. Assignment of Authority – The Principal must check any or all of the boxes in this section, to indicate the real property powers they wish to grant:
- Sale of Real Estate
- Purchase of Real Estate
- Management of Real Estate
- Refinancing
Step 3 – Article III. Term – The Principal must establish their selection of the term of the document – Check only one of the following selections:
- The Principal may choose a commencement date and a termination date
- The Non-Durable option would become effective immediately as of the date of the document and shall only terminate if the Principal becomes incapacitate, by revocation of this document or by death
- The Durable Option would make the document immediately available upon the date of the document and will only be terminated if the document is revoked by the Principal or in the event of the Principal’s death
Step 4 – Article VI. Revocation and Signatures – Must be signed before a Notary Public -Submit all of the following:
- Date this section in dd/mm/yyyy format
- Principal’s Signature
- Principal’s Printed Name
- AND
- Agent’s Signature
- Agent’s Printed Name
Step 5 – Affirmation by Witnesses – Each witness must read the affirmations then enter:
- The Witnesses must enter their names in their respective paragraphs
- Submit the Witnesses Signatures
- Submit witnesses printed names
Notarization-
When the document has been completed and the Notary Public has witnessed the signatures of all involved parties, the Notary shall then complete the acknowledgement with the required information and by affixing the official seal
Step 6 – Acceptance by Agent – The Agent must carefully review the acceptance. If the Agent is then in agreement, submit:
- The Agent’s Signature
- The Agent’s Printed Name
