Tennessee Durable Financial Power of Attorney Form | |
The Tennessee durable financial power of attorney form is a legal document that allows a Principal to provide powers for an Agent that the Principal feels may be trustworthy to act in their best interest with regard to the financial accounts, management of real property and personal property. This document will not grant powers for the Agent to make any decisions with regard to the Principal’s health care. The document will not be effective unless and until the Principal is incapacitated or disabled, unable to communicate their own wishes. This may only be determined by a Doctor and must be placed into writing by a Physician before the Agent may begin to manage any of the Principal’s finances or property.
This document must be clearly understood by the Principal. If the Principal is not clear with regard to how this particular document operates they may wish to contact an attorney to be clear and precise while completing the form.
The document may be revoked at any time by the Principal. This document should be signed before a Notary Public or witnesses, but doing so is optional.
How to Write
Step 1 – The Parties – Principal must provide the following:
- Print the name of the Principal
- Enter the name of the County of residence
- AND
- Submit the Printed name of the selected Agent
- Submit the Printed name of a Successor/Alternate Agent in the event the original agent can no longer properly serve the Principal
Step 2 – Additional Information –
- The Principal must read all of the remaining paragraphs before proceeding to signing the document
Step 3 – Signatures – The document should be signed before a Notary or Two Witnesses:
- Date the document in dd/mm/yy format
- Enter the Principal’s Signature
- AND
- The witnesses must enter their signatures into their respective lines provided
- Each witness must provide their street address
- City, State and Zip Code
- Enter the County in the state of Tennesse
Notarization –
As the document has been completed and the Notary has recorded all identifications and witnessed all signatures, the Notary Public shall then complete the remainder of the document, acknowledging the document is authentic.
Step 4 – Certificate of Physician About Disability – This document must be completed by a physician so to prove written proof of as Physician that a Principal is either disabled and is either permanently or temporarily unable to transact their own business on their own or is completely competent and able to transact their own business.
This document may be used each time there may be a request to determine the ability or disability status of a patient:
- The Physician, after examination of the Principal shall enter their name
- Check the applicable box
- The physician shall enter their signature
- The Physician shall enter their printed name
- Date the document in mm/dd/yy format
