Connecticut Real Estate ONLY Power of Attorney Form | |
The Connecticut real estate only power of attorney form is a document that provides written permission for an Agent to a delegated Agent to assist in keeping or participating in the sale, management, mortgage refinancing of or any other business with regard to the Principal’s real estate or a portion thereof. An Agent could be necessary when the Principal is ill or unavailable for any reason. This document must be signed before a notary public and two (2) witnesses.
How to Write
Step 1 – Selection of Agent – Provide the following information:
- Principal’s Name
- Physical Mailing address
- State of Residence
- AND
- The Name of the Agent
- Agent’s Mailing Address
- Agent’s State of Residence
Step 2 – Article I – Assignment of Authority – From here the Principal must select one or all of the powers to be granted:
- Sale of Real Estate
- Purchase of Real Estate
- Management of Real Estate
- Refinance of Real Estate
Step 3 – Article III – Term – Establishment of the Terms by the Principal
- The Principal may select a beginning and ending date
- If the Principal prefers a non-durable option, the document would be immediately available and will only end if the Principal becomes disabled or incapacitated
- Should a Principal select the durable option, the terms will begin immediately and will only end upon the Principal’s death
Step 4 – Article VI – Revocation – All parties who shall sign the document must be prepared to sign the document before a Notary Public:
- Date the signatures in dd/mm/yyyy format
- The Principal’s signature
- Print Name
- AND
- Agent’s Signature
- Printed Name
- AND
- Witnesses Signatures
- Printed names of Witnesses
- AND
Step 5 – When the parties are prepared to sign the document they must sign before a notary for the document to be acknowledged. Once the notary witnesses signatures, they shall complete the document in acknowledgement.
