Idaho Limited (Special) Power of Attorney Form | |
The Idaho limited (special) power of attorney form is a document which allows an individual (the Principal) to select another (the Agent or Attorney-in-Fact) to perform a specific responsibility on their behalf such as receiving mail, purchasing property, or handling certain financial affairs. It is necessary for the details of this arrangement to be relayed in no unclear terms within the document in order to describe the specific duties to be carried out by the Agent. In order to be considered legitimate, the document must also be signed by the Principal in the presence of a Notary Public as stated in the Idaho Code § 15-12-105.
How to Write
Step 1 – The Principal must read the sections at the beginning of the document as follows:
- Notice
- Incapacitation
- Revocation
- Witness and Notary
Step 2 – Parties –
- Enter the Principal’s Name
- Principal’s address
- City
- State
- AND
- Enter the Name of the Attorney In Fact/Agent
- Agent’s Street Address
- City
- State
- The state in which the document is drawn
- A Specified final act granted to the Attorney In Fact/Agent
Step 3 – Successor Attorney In Fact/Agent – In the event that the original Agent is unable or unwilling to serve, the Principal may enter the name of a successor:
- Enter the name of the Successor Agent
- Agent’s address
- City
- State
- Enter a specified final act that the Principal shall grant to the Agent
- Enter a detailed description of the exact powers to be granted to the Agent
Step 4 – The Principal must carefully review the following, prior to application of signature:
- Terms and Conditions
- Third Parties
- Compensation
- Disclosure
Step 5 – Signatures – All signatures must be applied in the presence of a Notary Public:
- Enter the Principal’s printed name
- Enter the date of the signature in dd/mm/yyyy format
- Enter the Principal’s Signature
- AND
- Printed name of Attorney In Fact/Agent
- Signature of the Attorney In Fact/Agent
- Date of Signature
- AND
- Printed name of Successor Attorney In Fact/Agent
- Attorney In Fact/Agent’s Signature
- Date of Signature
- AND
- The witnesses must read the attestation
- Enter the printed names of the witnesses
- Enter the signatures of each witness
Step 6 – Notary Acknowledgement –
After the Notary has witnessed all of the signatures, they will be required to complete the notary information to acknowledge the document.
- Acknowledgement and Acceptance of Appointment as Attorney In Fact/Agent
- Enter the Agent’s Printed Name
- Provide Agent’s Signature
- Date of Signature
- AND
- Acceptance of Appointment as Successor Attorney In Fact/Agent
- Enter the Successor Agent’s Printed Name
- Provide Successor Agent’s Signature
- Date of Signature
