Michigan General Financial Power of Attorney Form

The Michigan general financial power of attorney form is a legal document that is prepared by a Principal to designate an Agent to whom they would transfer unlimited powers over the Principal’s financials in the event of any kind of absence including illness. This document will become effective upon completion and notarization of the document. The powers will not remain in effect should the Principal become incapacitated or disabled. This document will protect the Principal’s rights to continue the control of their finances for as long as they are able to do so

The Principal may include limitations/restrictions. The Agent should treat this document with respect and good intention acting as if the Principal were available at all times and do their business on their own.

This document must be notarized or attested by two (2) witnesses. The Principal has the right to revoke this document at their discretion.

How to Write

Step 1 – Download the document – The Principal must read all of the following titled sections:

  • Notice
  • Incapaciation
  • Revocation
  • Witness and Notary

Step 2 – The Parties – Enter:

  • Name of the Principal
  • Street Address
  • City
  • State
  • AND
  • Enter the name of the delegated Agent
  • The Agent’s complete address
  • City
  • State
  • AND
  • Enter the state whereas the document is being executed
  • AND
  • Provide the name of a Successor Agent (Optional) should the original Agent become unable to serve on behalf of the Principal
  • Successor Agent’s full Address
  • City
  • State
  • AND
  • The state where the document shall be executed

Step 3 – The Principal must review the additional titled sections:

  • Terms and Conditions
  • Third Parties
  • Compensation
  • Disclosure

Step 4 – Signatures – Must be signed before a Notary Public:

  • The Principal must submit their signature
  • Date the signature in dd/mm format
  • AND
  • Print/Type
  • name of the Agent
  • Read the information regarding the acknowledgement
  • Agent must submit their signature
  • Date the signature in mm/dd/yyyy format
  • AND
  • Enter the printed/typed name of the Successor Agent
  • Successor Agent must read the information provided
  • The Successor Agent must submit their signature
  • Date the signature in mm/dd/yyyy format

Step 5 – Notary Acknowledgement –

When the Notary has witness all of the signatures, they will then enter all of their required information acknowledging the document

Step 6 – Acknowledgement and Acceptance of Powers by Agents – Provide the following:

  • Print the names of each Agent (respectively)
  • The Agent’s must enter their signatures
  • Date their signatures in mm/dd/yyyy format

Step 7 – Witness Attestation – Both witnesses must read the information provided:

  • Enter the printed/typed names of each witness in the paragraph
  • Each witness must submit their signatures
