Missouri General Financial Power of Attorney Form | |
The Missouri general financial power of attorney form is a document used by a Principal to designate financial decisions to a designated Agent/Attorney-In-Fact. This document will provide very specific information regarding what powers the Principal would wish to allow the Agent. Initially, the document would hand all financial powers to the Agent. However, this does not have to remain. The Principal may restrict and/or limit the powers transferred to the Agent. The Principal may also strike through any of the statements they aren’t comfortable with.
All of the powers must be exercised by the Agent, according to the wishes of the Principal and not their own. The Agent must act on behalf of the Principal, as if the Principal were available to make their own decisions regarding their own financial affairs. This document will not remain in effect if the Principal becomes incapacitated.
This form must be Notarized with all signatories signing in person and with presentation of identification, before a Notary Public. The document may be revoked by the Principal at any time, by providing written notice to the Agent. The Principal will have the opportunity to elect a Successor Agent, in the event the initial Agent is unable to any longer, carry out the requirements and/or wishes of the Principal.
How to Write
Step 1 – Download the Document – Submit the following information:
- The Principal shall read all of the following Titled Sections before they proceed
- Notice
- Incapacitation
- Revocation
- Witness and Notary
- In addition, in the lower portion of the document:
- Terms and Conditions
- Third Parties
- Compensation
- Disclosure
Step 2 – Principal’s Information –
- Principal’s name
- Principal’s Street Address
- City
- State
- AND
- Agent’s name
- Agent’s Address
- City
- State
- AND
- The name of any Successor Agent (Optional)
- Successor’s Street Address
- City of residence
- State
Step 3 – Signatures – Must be provided only in the presence of a a state licensed Notary Public:
- Enter the Principal’s Signature
- Date the signature in dd/mm/yyyy format
- AND
- Agent’s Printed Name
- Enter the Agent’s Signature
- Date of the signature in mm/dd/yyyy format
- AND
- Successor Agent’s Printed Name
- Enter the Successor’s Signature
- Date the signature in mm/dd/yyyy format
Step 4 – Notarization –
Once the Notary has witness all signatures, the notary will then submit all of the requirements to acknowledge the document, afterward, affixing the official state notary seal
Step 5 – Acknowledgement and Acceptance of Agents – The Agent’s must review the acknowledgement statements – Enter the following:
- Printed the name of the Agent(s)
- Agent (s) signatures(s)
- Date the signatures in mm/dd/yyyy format
- AND
The Witnesses must read the Witness Attestation – Enter the following:
- Printed names of the Witnesses
- Signatures of the Witnesses
