Mississippi Power of Attorney in accordance with MS Code § 87-3-105 (2013), is a document that is provided by a Principal so that they may grant authority to another person who shall serve as their”Attorney In Fact” or “Agent.” The Agent would act on behalf of the Principal by accepting full full or limited business or health care decisions in their absence or as a result of incapacitation or disability. Depending upon the the wishes of the Principal, the document may become immediately available to the Agent, or, it may become available only at the time that the Principal is no longer capable of being present to attend to their own affairs.
State Definition – Universal Citation: MS Code § 87-3-105 “A durable power of attorney is a power of attorney by which a principal designates another his attorney in fact in writing and the writing contains the words “This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or lapse of time,” or “This power of attorney shall become effective upon the disability or incapacity of the principal,” or similar words showing the intent of the principal that the authority conferred shall be exercisable notwithstanding the principal’s subsequent disability or incapacity, and, unless it states a time of termination, notwithstanding the lapse of time since the execution of the instrument.”
