New Mexico General Financial Power of Attorney Form | |
The New Mexico general financial power of attorney form is a legal document would be completed by a Principal so that they may grant powers for an Agent to whom they would choose, to transfer the granted powers over the Principal’s financials, in the event any illness or extended absence. This document will become effective immediately upon completion of the document. (Once Notarized) The document shall not remain in effect should the Principal become incapacitated. This document will protect the Principal’s rights to continue the control of their finances for as long as they are capable of doing their own business.
The document does provide space for the Principal to include limitations/restrictions, limiting and or/restricting what the Agent may do. The Agent should treat this document with consideration as they make decisions on behalf of the Principal, and act as if the Principal would, if they were able to care for their own finances.
This document must be Notarized. The Principal will have the right to revoke this document at their discretion.
How to Write
Step 1 – Download the document – The Principal must review the following :
- Notice
- Incapaciation
- Revocation
- Witness and Notary
Step 2 – The Parties – Provide the following:
- Name of the Principal
- Their Street Address
- City
- State
- AND
- Name of the Agent
- The Agent’s address
- City
- State
- AND
- The state where the document will be utilized
- AND
- Provide the name of a Successor Agent (Optional) in the even that the original Agent should become unable to act on behalf of the Principal
- Successor Agent’s Address
- City
- State
- AND
- The state whereas the document would be executed
Step 3 – The Principal must review all of the additional titled sections:
- Terms and Conditions
- Third Parties
- Compensation
- Disclosure
Step 4 – Signatures – Must be signed before a Notary Public:
- The Principal must submit their signature
- Date the signature in dd/mm format
- AND
- Print/Type
- Name the Agent
- Read acknowledgement information
- The Agent must submit their signature
- Date the signature – mm/dd/yyyy format
- AND
- Submit the printed name of the Successor Agent
- Successor Agent must review the provided information
- The Successor Agent must submit their signature
- Date the signature in mm/dd/yyyy format
Step 5 – Notary Acknowledgement –
When the Notary has witness all of the signatures, they will then enter all of their required information acknowledging the document
Step 6 – Acknowledgement and Acceptance of Powers by Agents – Provide the following:
- Print the names of each Agent (respectively)
- The Agent’s must enter their signatures
- Date their signatures in mm/dd/yyyy format
Step 7 – Witness Attestation – Both witnesses must read the information in this section:
- Enter the printed names of each witness in the paragraph
- Each witness must submit their respective signatures
