Virginia Limited (Special) Power of Attorney Form

The Virginia limited (special) power of attorney form, as opposed to a general power of attorney form which provides a broad and often durable power to the Attorney-in-Fact, is used to specify the exact duties that the Principal wishes the Attorney-in-Fact to undertake on their behalf. This can be especially useful if the transaction is to occur only once and the power of attorney is to be terminated upon completion of the task for which the Principal is requiring an Agent. In the State of Virginia, it is required that the document be signed by the Principal and for the signature to be acknowledged before a certified Notary Public (§ 64.2-1603).

How to Write

Step 1 – Notice to Principal – Review:

  • Notice
  • Incapacitation
  • Revocation
  • Witness and Notary

Step 2 – The Parties – Enter the following:

  • Principal’s name
  • Street Address
  • City
  • State
  • AND
  • Agent’s name
  • Street Address
  • City
  • State
  • Enter the state wherethe powers will be exercised
  • AND
  • Successor Agent’s name (optional)
  • Street Address
  • City
  • State
  • Enter the state where the powers document shall be utilized

Step 4 – Additional Titles – The Principal must review the following:

  • Terms and Conditions
  • Third Parties
  • Compensation
  • Disclosure

Step 5 – Signatures – Notary and witnesses required:

  • Prinicpal’s printed name
  • Date the signature in dd/mm format
  • Principal’s Signature
  • AND
  • Printed name of the Agent
  • Agent’s Signature
  • Date the signature in mm/dd/yyyy format
  • AND
  • Submit the printed name of the Successor Agent (optional)
  • The Successor Agent’s signature
  • Date the Successor’s signature in mm/dd/yyyy format

Step 6 – Notary Acknowledgement –

  • Once the notary has witnessed the signatures, the required information for acknowledgment shall be completed

Step 7 – Acknowledgement and Acceptance of Appointment as Agent and Successor Agent –

  • Agents must read their acceptance information
  • Enter the name of the Agents (respective)
  • Agents signatures
  • Date the signatures in mm/dd/yyyy formats

Step 8 – Witness Attestation – The witnesses shall review the attestation – Submit the following:

  • Witnesses – enter their printed names
  • Witnesses submit their respective signatures
