Maine General Financial Power of Attorney Form | |
The Maine general financial power of attorney form is a document that a Principal would use to designate financial decision making powers to an elected Attorney-In-Fact/Agent. This document will provide specific information with regard to what the powers entail. Initially, the document would hand all financial powers to the Agent, however, the Principal may certainly impose restrictions and/or limitations. All of the powers must exercised by the Agent, should be used cautiously, acting as if the Principal were available to take care of their own financial affairs, according to the Principal’s wishes. This document will not remain in effect should the Principal become disabled or incapacitated.
This form must be Notarized with all signatories signing before a Notary Public. The document may be revoked by the Principal as they so desire, by providing written notice to the Agent. The Principal will have the opportunity to elect a Successor Agent, in the event the initial Agent is unable or unwilling to carry out the requirements of the the document.
How to Write
Step 1 – The Principal must Download the Document –
- The Principal must read all of the following Titled Sections before proceeding
- Notice
- Incapacitation
- Revocation
- Witness and Notary
- Additnionally in the lower portion of the document:
- Terms and Conditions
- Third Parties
- Compensation
- Disclosure
Step 2 – Principal’s Information – Enter:
- The name of the Principal
- The Principal’s Street Address
- City of residence
- State
- AND
- The Agent’s name
- The Agent’s Street Address
- City of residence
- State
- AND
- The name of any Successor Agent (Optional)
- Successor’s Street Address
- City of residence
- State
Step 3 – Signatures – Must be submitted before a state licensed Notary:
- Enter the Principal’s Signature
- Date of the signature in dd/mm/yyyy format
- AND
- Agent’s Printed Name
- Enter the Agent’s Signature
- Date of the signature in mm/dd/yyyy format
- AND
- Successor Agent’s Printed Name
- Enter the Successor’s Signature
- Date the signature in mm/dd/yyyy format
Step 4 – Notarization –
As the Notary Public has witness all signature, the notary shall then submit all of the requirements necessary to acknowledge the document
Step 5 – Acknowledgement and Acceptance of Agents – The Agent’s must read the acknowledgement statements and enter the following information:
- Print the name of the Agent(s)
- Agent’s must provide signatures
- Agents must date their signatures in mm/dd/yyyy format
- AND
(OPTIONAL) The Witnesses must read the Witness Attestation – Enter:
- The printed names of the Witnesses
- The Signatures of the Witnesses
