Maine Limited (Special) Power of Attorney Form

The Maine limited (special) power of attorney form is a legal document that states that an Attorney-in-Fact has the power to carry out certain responsibilities on the behalf of a Principal. It is important that the limitations (hence the form’s name) be stated within the document in no unclear terms in order to ensure that the duties of the Agent are understood.

The document does not provide the Attorney-in-Fact with the authority to make medical decisions on the Principal’s behalf and should be used specifically for financial matters such as paying bills, purchasing property, and so on and so forth.

Signing – In accordance with the Maine Uniform Power of Attorney Act (18-C § 5-905), this document must be signed by both parties and will only be considered valid once the signature of the Principal has been acknowledged by a Notary Public.

How to Write

Step 1 – The Principal must download the document  –

  • The Principal must read the following Titled Sections:

  • AND – in the lower portion of the document:
  • Terms and Conditions
  • Third Parties
  • Compensation
  • Disclosure

Step 2 – Principal’s Information – Enter the following information:

  • Name of the Principal
  • Principal’s Street Address
  • City
  • State
  • AND
  • Agent’s name
  • Street Address
  • City of residence
  • State
  • AND
  • The name of any Successor Agent (This is Optional)
  • Successor’s Street Address
  • City
  • State

Step 3 – Signatures – Must be signed before a  licensed Notary:

  • Provide the Principal’s Signature
  • Date the signature in dd/mm/yyyy format
  • AND
  • Agent’s Printed Name
  • Enter the Agent’s Signature
  • Date of the signature in mm/dd/yyyy format
  • AND
  • Successor Agent’s Printed Name
  • Enter the Successor’s Signature
  • Date the signature in mm/dd/yyyy format

Step 4 – Notarization –

As the Notary Public has witnessed the signatures, the notary shall submit the requirements necessary to acknowledge the document

Step 5 – Acknowledgement and Acceptance of Agents – The Agent’s must review the information in the acknowledgement statements and enter the following:

  • Print the name of the Agent(s)
  • Agent’s must submit signatures
  • Agents must date their signatures in mm/dd/yyyy format
  • AND

(OPTIONAL) The Witnesses must read the Witness Attestation – Provide the following

  • The printed names of the Witnesses
  • The Signatures of the Witnesses
