Oklahoma Limited (Special) Power of Attorney Form | |
The Oklahoma limited (special) power of attorney form is used when a Principal wishes to permit an Agent to execute specific duties on their behalf (e.g. receiving mail, purchasing property, cashing checks). This type of legal document allows for the establishment of a limited scope of authority which may be terminated once a duty has been performed or after a predetermined length of time. Within the State of Oklahoma, a Principal must sign the form in front of a notary public.
How to Write
Step 1 – Titled Sections – Principal must read the following titles:
- Notice
- Incapacitation
- Revocation
- Witness and Notary
Step 2 – The Parties – Provide:
- The Principal’s name
- The Principal’s address
- City
- State
- AND
- The Agent’s name
- Agent’s Address
- City
- State
- AND –
The Principal may decide to appoint one or more Successor Agents, in the event the initial Agent would become unwilling or unable to act reasonably on behalf of the Principal:
- Enter the names of one or more Successor Agents (Optional)
- The Successor(s) current Address
- City
- State
- Name of the state where the document will be executed
Step 3 – Additional Titled Sections – Read the following information before proceeding:
- Terms and Conditions
- Third Parties
- Compensation
- Disclosure
Step 4 – Signatures –Parties must present before a notary:
- Print the name of the Principal
- Date the Principal’s signature in dd/mm format
- Submit Principal’s Signature
- AND
- Print Agent’s name
- Review the remainder of the information
- Submit Agent’s signature
- Date Agent’s signature in mm/dd/yyyy format
- AND
- Enter the name of a Successor Agent
- Review the remaining information
- Successor Agent must provide a Signature
Step 5 – Notarization –
Once the Notary witnesses all signatures, the notary will provide all of the required notary information and affix the notary’s state seal in acknowledgement of the document
Step 6 – Acknowledgement and Acceptance of Appointment of Agent(s) –The Agent(s) must first review the acceptance statement and enter the following:
- The Agent(s) printed name(s)
- Review all information contained in each section
- Both Agent(s) enter their signatures
- Date the Agent(s) signatures in mm/dd/yyyy format
Step 7 – Witness Attestation (OPTIONAL) – Witnesses must:
- Both witnesses must review the witness attestation information provided
- Print the Witnesses names
- Submit Witnesses signatures (respectively)
