Utah Durable Financial Power of Attorney Form

The Utah durable financial power of attorney form is a legal document that allows a Principal to authorize powers to an Agent who would oversee the finances, personal property and real property, in the absence of the Principal. The selected powers chosen within this form, will commence upon the date  of execution of this document. The powers shall remain in effect even if the Principal becomes incapacitated or incompetent, unless the Principal revokes the document prior to incapacitation. No powers will be granted to make health care decisions on behalf of the Principal with this document.

The Principal should review this document, thoroughly, before the completion and application of signatures. If the Principal is uncertain of the language contained within this document, they may choose to select and speak with an attorney for legal advice. The document must be witnessed by a Notary Public. The form may be revoked at the discretion of the Principal

 

How to Write

Step 1 – Titled Sections – Review the following titles:

  • Notice
  • Incapacitation
  • Revocation
  • Witness and Notary

Step 2 – The Parties – Enter the following:

  • Name of the Principal
  • Street Address
  • City
  • State
  • AND
  • Name the Agent
  • Street Address
  • City
  • State
  • Enter the state where this powers document would be utilized
  • AND
  • Name a Successor Agent (optional)
  • Street Address
  • City
  • State
  • Provide the state where the powers document shall be acted upon by the Successor
  • The Principal must review the Terms and Conditions before proceeding

Step 3 –  Additional Titles – The Principal must also review:

  • Third Parties
  • Compensation
  • Disclosure

Step 4 – Signatures – Must enter before a Notary Public:

  • Principal’s Printed Name
  • Date the signature in dd/mm format
  • Principal’s Signature
  • AND
  • The printed name of the Agent
  • The Agent’s Signature
  • Date the signature in mm/dd/yyyy format
  • AND
  • Provide the printed name of a Successor Agent (optional)
  • Successor Agent’s signature
  • Date Successor’s signature in mm/dd/yyyy format

Step 5 – Notary Acknowledgement –

Once the notary has witnessed all signatures, they’ll acknowledge the document by entering all of the required notary public information required to acknowledge the validity of the document

Step 6 – Acknowledgement and Acceptance of Appointment as Agent and Successor Agent – Enter the following:

  • Agent must review the acceptance information:
  • The name of each Agent in their respective paragraphs
  • The Agent’s signatures
  • Date the signatures in mm/dd/yyyy format

Step 7 – Witness Attestation (optional). Enter:

  • Witnesses must enter their printed names
  • Witnesses must provide their signatures
