The Minnesota minor child power of attorney form is a document that permits the the parent of a child to temporarily transfer parental responsibilities to a guardian in the event, for whatever reason the parent(s) will be absent or are experiencing illness.
The Guardian, who shall accept appointment, must enter into the agreement with the child(ren’s) best interest in mind, executing their responsibilities as if the parent(s) were available to care for their children and make their usual decisions.
This document must be signed by all signatories, before a licensed Notary Public. This document may also be revoked at any time in writing by the parent(s)
How to Write
Step 1 – Location –
- Begin by entering the county in which the document is executed in the top left side of the document
Step 2 – The Parties – Enter the following:
- The name of the Parent(s)
- The County of the execution of the document
- Enter the child(ren’s) name(s) – (If there are more children’s names that must be recorded, enter all of the children’s information on a second sheet and attach it to this document
- Child(ren’s) date(s) of Birth in mm/dd/yyyy format
- Enter the name of the person who shall serve as Guardian
- Enter the County where the Guardian resides
- Again, enter the child(ren’s) names
- Enter a period for which the children will remain with the Guardian (up to one year (12 months)
- Again enter the name of the Guardian
- Enter the child(ren’s) name(s)
- Read A,B and C
- Enter the Guardian’s name
- Again enter the name of the Guardian
- Enter the name(s) of the children
Step 2 – Parental Responsibilities With Regard to This Document –
- Enter the parent’s name
- Parent must read the next two statements in this section and circle the appropriate letter representing the proper statement if any
- Enter the date in which the signatures are being submitted in dd/mm/yyyy format
- Enter the Parent’s signature
- At the bottom of the form, enter the signature of the Agent./Guardian
Step 3 – Notarization –
When the parent has completed the document, the Notary Public must witness both signatures. The notary shall then complete this section of the form, acknowledging the contents of the document
