Maine Real Estate ONLY Power of Attorney Form | |
The Maine real estate only power of attorney form is a document that is provided to allow the Principal (owner/title holder) of real property, to designate an Agent to oversee the sale, purchase, management and/or refinancing of their property in their absence. The document will transfer powers to someone else, of the Principal’s choosing to perform business acts as if the Principal were present. This form will not extend to powers over financials nor will the Agent have the ability to make medical decisions on behalf of the Principal. This document provides powers for real property only.
This document must be notarized. The document may be revoked any time, by the Principal. The Principal may place notice in writing and deliver it to the Agent.
How to Write
Step 1 – Delegation of an Agent -The Parties – Enter:
- The full name of the Principal
- The current street address
- City of residence
- State
- AND
- The full name of the appointed Agent
- Street Address
- City
- State
Step 2 – Article I. Assignment of Authority – The Principal must read the statements in this section and check any or all of the applicable boxes as follows:
- Sale of Real Estate
- Purchase of Real Estate
- Management of Real Estate
- Refinancing
Step 3 – Article III. Term – The Principal must initial and check only one of the terms that would best indicate the preference of the Principal:
- Select a simple beginning and ending date
- The Non-Durable Option would become immediately effective and would only terminate with the death of the Principal or by revocation
- The Durable Option would become immediately available and only terminate upon the death of the Principal or if the Principal should revoke the document
Step 4 – Article VI. Revocation and Signature(s) –
- Enter the date of the signatures in dd/mm/yyyy format
- Provide the Principal’s signature
- Principal’s printed name
- AND
- Enter the Agent’s signature
- The Agent’s printed name
Step 5 – Affirmation of Witnesses – The Witnesses must review their respective affirmations and enter:
- Printed name of each witness
- Witnesses Signatures
- Printed names of witnesses
Step 6 – Notary Acknowledgement –
When the document has been completed and the signatures have been submitted before the notary, the notary will then complete the remainder of the acknowledgment, affixing the official seal (if any)
Step 7 – Acceptance by Agent – The initial agent must review the acceptance statement:
- The Agent must enter their Signature
- Enter the Agent’s printed name
