Minnesota Real Estate ONLY Power of Attorney Form

The Minnesota real estate only power of attorney form is a legal document that will, at the Principals selection, appoint an Agent to see to the business regarding the management, refinancing, sale of, puchase of, management of or to complete transactions of any of the Principal’s specified real property. This document will not allow an Agent to make health care decisions, nor will they have access to make decisions with regard to finances or personal property.

The named Agent should enter into the agreement with the best intentions of the Principal in mind, inasmuch as they will be overseeing the complete care of the Principal’s property/properties, in their absence or due to illness until recovery or death.

The signatures submitted to this document must be entered before a Notary Public. As well, this document may be revoked at the discretion of the Principal in writing and delivered to the appointed Agent.

How to Write

Step 1 – The Parties – Provide the following:

  • Enter the name of the Principal (full name)
  • The Street Address of the Principal
  • City
  • State
  • AND
  • Enter the name of the appointed Agent
  • Enter the Agent’s Street Address
  • City

Step 2 – StateArticle I. Assignment of Authority – The Principal must check and initial one, more or all of the following powers to be granted to the Agent:

  • Sale of Real Estate
  • Purchase of Real Estate
  • Management of Real Estate
  • Refinancing

Step 3 – Article III. Term – The Principal must establish the term of the document in this section. Select one option from the following, on the form, initial the line and check the box:

  • The Principal may select a beginning and ending date
  • Non-Durable selection would make the document immediately available to the Agent but shall terminate upon the incapacity, death or revocation of the form
  • The Durable selection, would make the document immediately available to the Agent and shall only terminate if the Principal chooses to revoke the powers to the Agent, or upon the death of the Principal

Step 4 – Article VI. Revocation (Signatures) – All signatures must occur within the purview of a Notary Public

  • Enter the date of the signatures in mm/dd/yyyy format
  • The Principal must submit their signature
  • Principal’s printed or typed name
  • AND
  • Enter the Agent’s Signature
  • Agent’s printed or typed name
  • AND

Witness Information (optional) –

  • Both witnesses must read the paragraphs
  • Enter the witnesses printed names
  • Enter the witnesses respective signatures
  • Enter the witnesses printed or typed names

Step 5 – Notarization –

The Notary Public, after completion of the document, shall witness all signatures. The Notary shall then complete the section requiring their information that will acknowledge the completed, signed document

Step 6 – Acceptance of Agent –

  • The Agent must read and agree to the statement in this section
  • Submit the Agent’s Signature
  • Submit their printed or typed name
