The real estate power of attorney is a document that allows another individual or entity to handle the management, leasing, selling, or the purchasing of property on their behalf. It grants limited or broad powers to handle a specific task or the general responsibilities of real estate, with always a fiduciary duty to perform in the best interests of the principal.
Closings – This form is most commonly used in regards to real estate agents and attorneys when handling the sale of property. The owner will oftentimes allow a representative to sign all the closing documents on their behalf.

How to Write
Step 1 – Parties – Provide the following information:
- Enter the Principal’s full name
- Street address
- City
- State
- AND
- Enter the Agent’s full name
- Street address
- City
- State
Step 2 – Assignment of Authority – Initial and check any or all boxes indicating authorized powers:
- Sale of Real Estate
- Purchase of Real Estate
- Management of Real Estate
- Refinancing
Step 3 – Term – Establish the term of the document:
- Initial and check only one, to indicate preferred term
Step 4 – Signatures – Must be entered in service of a notary public:
- Date document in dd/m/yy format
- Principal’s signature
- Print the Principal’s name
- AND
- Agent’s signature
- Print Agent’s name
Witnesses Affirmations – Witnesses will review and agree to the statement:
- Enter witnesses names
- Submit witnesses signatures
- Print witnesses names
Step 5 – Notarization –
- Signatures shall be witness by the notary
- After witness of signatures, the notary shall enter remaining information required, in acknowledgment of the document
Step 6 – Agent Acceptance –
- Agent must review and agree to the affirmation
- Agent must provide signature
- Print the Agent’s name
